If you need a NIE in Spain as a non-resident, the first thing to understand is that a NIE is simply an identification number.

It does not make you resident in Spain. It does not give you permission to live or work in Spain. And it is not the same thing as a CUE or TIE.

A non-resident may need a NIE for an economic, professional or social reason connected with Spain.

NIE: Número de Identidad de Extranjero.

Purpose: Identifies a foreigner in Spanish administrative systems.

Residence status: A NIE by itself does not grant residence.

Main form: EX-15.

What Is a NIE?

NIE stands for:

Número de Identidad de Extranjero

It is the personal identification number assigned to a foreign national for dealings with Spanish public authorities and many private organisations.

A NIE typically looks something like:

X1234567A

The number normally remains associated with you permanently.

If you later become resident in Spain, you normally continue using the same NIE.

Can You Have a NIE Without Being Resident in Spain?

Yes.

This is exactly what a standalone non-resident NIE application is for.

Under the Spanish foreigner-documentation framework, a NIE can be assigned to a foreigner who has an economic, professional or social interest connected with Spain.

You therefore do not need to become resident merely because you need a Spanish identification number.

Important: A NIE proves that a Spanish foreigner identification number has been assigned to you. It does not prove legal residence in Spain.

Why Might a Non-Resident Need a NIE?

Common reasons include:

  • buying or selling Spanish property;
  • accepting an inheritance;
  • carrying out certain tax procedures;
  • setting up or participating in a business transaction;
  • signing certain contracts;
  • financial or banking matters;
  • professional activities connected with Spain; or
  • another economic, professional or social reason accepted by the authorities.

The important point is that the application should explain why you need the number.

Do You Need to Own Property to Get a NIE?

No.

Property purchase is one common reason for requesting a NIE, but it is not the only one.

The underlying test is whether you have a legitimate economic, professional or social interest connected with Spain.

Do You Need a NIE Before Buying Property?

A NIE is normally needed to complete important administrative and tax aspects of a Spanish property purchase.

For that reason, buyers often obtain the number before the final transaction is completed.

However, buying property does not itself give you Spanish residence rights.

Property ownership and immigration residence are separate matters. A Spanish home plus a NIE does not equal Spanish residency.

What Is the “White NIE”?

The expression “white NIE” is informal terminology commonly used by foreigners and property professionals.

It usually refers to the white paper certificate confirming assignment of a NIE.

There is no separate legal immigration status called a “white NIE.”

The legally important element is the NIE number.

What Form Do You Use?

The standard form is:

It is important to understand that EX-15 is used for more than one procedure.

For example, it can be used in connection with:

  • NIE assignment;
  • a certificate of residence; and
  • a certificate of non-residence.

Using the same form does not make those procedures interchangeable.

NIE Assignment vs Certificate of Non-Residence

This is a common source of confusion.

Procedure What You Are Asking For
NIE assignment A Spanish foreigner identification number.
Certificate of non-residence A certificate stating that you are not registered as resident in Spain.

You can therefore need a NIE without needing a certificate of non-residence.

Do not select a non-residence certificate merely because you are currently a non-resident. If what you actually need is a NIE number, request NIE assignment.

What Documents Do You Normally Need?

The exact supporting documentation can depend on your circumstances and where you apply, but a typical application involves:

  • completed EX-15 form;
  • valid passport or other accepted identity document;
  • a copy of the relevant identity-document pages;
  • evidence or explanation showing the economic, professional or social reason for requesting the NIE;
  • proof of payment of the applicable government fee; and
  • representation documents if another person is applying on your behalf where permitted.

Always check the official requirements immediately before applying.

Do You Need a Notarised Letter Explaining Why You Need a NIE?

There is no universal rule requiring every applicant to provide a notarised justification.

The application requires you to state the reason for requesting the NIE, and the authorities can require supporting evidence appropriate to that reason.

For example, documentation relating to a property purchase, inheritance, professional transaction or another administrative need may support the application.

The evidence required depends on the circumstances.

Do not confuse “you must justify why you need a NIE” with “every justification must be notarised.”

Where Can You Apply for a Non-Resident NIE?

There are two broad routes:

  • apply in Spain through the competent Policía Nacional or foreigner-documentation authority; or
  • apply from abroad through a Spanish consular office that accepts the procedure.

The exact competent office and appointment arrangements should be checked for your location.

Applying for a NIE in Spain

If you apply while physically in Spain, the application is normally handled through the competent foreigner-documentation office or Policía Nacional office.

You may need a Cita Previa.

Appointment labels vary, but look for the procedure corresponding to Asignación de NIE or the equivalent wording used by the office.

Do not automatically choose a CUE, TIE or certificate appointment merely because the word “NIE” appears in the description.

Can You Apply for a NIE While in Spain as a Visitor?

Potentially, yes, provided the requirements for standalone NIE assignment are met.

However, under the current immigration framework, a person applying for NIE assignment in Spain must not be in Spain in an irregular immigration situation.

The NIE application itself does not extend your permitted stay or change your immigration status.

Applying for a NIE From Abroad

If you live outside Spain, you may be able to submit the application through the competent Spanish consular office.

Consulates act as an administrative channel for the application rather than issuing a different type of NIE.

Consular procedures can have their own appointment and document-submission arrangements, so check the website of the relevant Spanish consulate before attending.

Can Someone Apply for a NIE for You?

Representation is possible in some NIE procedures where the representative is properly authorised.

The authorities may require:

  • proof of the representative’s identity;
  • evidence of the authority to act on your behalf; and
  • the applicant’s required supporting documents.

The appropriate power or authorisation depends on the procedure and circumstances.

Do not assume that simply handing your passport copy to an estate agent or intermediary creates valid legal representation.

What Fee Do You Pay?

NIE assignment through Policía Nacional uses Modelo 790 Código 012.

The amount is determined by the specific fee concept selected on the current official form.

Should You Pay the Fee Before the Appointment?

Where proof of payment is required, the safest approach is to generate the correct fee form and pay it before attending, following the current official instructions.

Bring the required proof of payment with you.

An unpaid Modelo 790 form is not the same thing as proof that the fee has been paid.

How Long Does NIE Assignment Take?

The statutory procedure provides a relatively short resolution period once the application has entered the competent administrative process.

However, the practical total time can be much longer because you may first need to:

  • find an available appointment;
  • collect supporting evidence;
  • pay the fee;
  • submit the application; or
  • wait for consular transmission if applying abroad.

Do not confuse the formal administrative resolution period with the entire real-world process from deciding you need a NIE to receiving the document.

Does the NIE Expire?

The NIE number itself normally does not expire.

It remains associated with you.

However, a certificate or document showing the number may have a date of issue or may need to be recently issued for a particular transaction.

That does not mean the underlying NIE has expired.

Do You Need a New NIE When You Become Resident?

No.

If you later move to Spain, you normally retain the same NIE.

What changes is your immigration or residence documentation.

For example:

EU citizen: The same NIE can later appear on the CUE.

Non-EU citizen: The same NIE can later appear on the TIE.

What if You Later Move to Spain as an EU Citizen?

A standalone NIE does not replace EU residence registration.

If you are an EU, EEA or Swiss citizen and later move to Spain for more than three months, you may need to register under the EU residence regime and obtain a CUE if you meet the applicable conditions.

Your existing NIE normally remains the same.

The NIE number does not give you permission to move to Spain.

You still need the correct visa, residence, work, study, family or other immigration route that applies to your circumstances.

If your immigration status requires a TIE, that card will normally contain the NIE you already have.

Does a NIE Make You Spanish Tax Resident?

No.

You can have a NIE while remaining tax resident in another country.

Spanish tax residence is determined under separate tax rules.

The main domestic tests include matters such as:

  • whether you spend more than 183 days in Spain during the calendar year; and
  • whether the main nucleus or base of your activities or economic interests is in Spain.

There is also a rebuttable family presumption in certain circumstances.

Does a NIE Give You Spanish Healthcare?

No.

A NIE is an identification number, not a healthcare entitlement.

Healthcare access depends on a separate legal basis, which may involve Spanish Social Security, employment, pension status, an S1, beneficiary status, another public entitlement or private insurance depending on your circumstances.

The Padrón Municipal is the municipal register of people who habitually live in a municipality.

It is entirely separate from NIE assignment.

Your NIE is an important identifier for Spanish electronic administration, but the number alone is not usually enough to authenticate yourself online.

Once established in Spain, you may want to obtain:

  • an FNMT Certificado Digital; and
  • Cl@ve registration.

These allow access to many tax, Social Security and other government services.

“Because I am a non-resident, I should request a certificate of non-residence.”

Not necessarily. If what you need is a NIE number, request NIE assignment. The two procedures are distinct.

“My NIE expires after three months.”

The NIE number itself normally does not expire.

“I need a new NIE when I become resident.”

No. You normally keep the same number.

“A NIE means Hacienda considers me tax resident.”

No. Tax residence is determined separately.

“A NIE gives me public healthcare.”

No. Healthcare entitlement is separate.
